By accessing and using InterviewGlitch (including our website, desktop applications, mobile apps, and services), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Services.

These Terms constitute a legally binding agreement between you and InterviewGlitch (operated by Glitchworks Technologies Pty Ltd, ABN 70693143896, ACN 693143896, "Company," "we," "us," or "our").

We reserve the right to modify these Terms at any time. Material changes will be posted on this page with an updated date. Your continued use of the Services constitutes acceptance of the modified Terms.

2. Use License

2.1 Grant of License

We grant you a limited, non-exclusive, non-transferable license to access and use InterviewGlitch for your personal use in accordance with these Terms. This license does not permit you to:

• Modify or copy the materials or Services
• Use the Services for any commercial purpose without written permission
• Attempt to decompile, reverse engineer, or discover source code
• Remove any copyright or proprietary notices
• Transfer the license to another person
• Rent, lease, or lend the Services
• Use the Services for any unlawful purpose

2.2 Restrictions

You agree not to access or use InterviewGlitch for any purpose other than legitimate interview preparation. Prohibited activities include:

• Using our Services during actual job interviews (without employer consent)
• Recording or sharing interview content without consent
• Using the Services for academic dishonesty or cheating
• Attempting to gain unauthorized access to our systems
• Transmitting viruses, malware, or harmful code
• Harassing, threatening, or abusing others through the Services
• Scraping or bulk downloading of data

3. Account Responsibility

3.1 Account Registration

To use InterviewGlitch, you must create an account with a valid email address. You agree to:

• Provide accurate, current, and complete information
• Maintain the confidentiality of your password
• Accept responsibility for all activities under your account
• Notify us immediately of unauthorized access

3.2 Account Requirements

• You must be at least 13 years old (or the applicable legal age in your jurisdiction)
• You must not create multiple accounts to circumvent plan limitations
• You agree not to share your account with others
• You are responsible for all activity on your account

3.3 Account Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Violate applicable laws
• Have not used your account for 24 consecutive months
• Use the service to harm others

You may delete your account at any time through your account settings. Upon deletion, all personal data will be permanently removed within 30 days.

4. Subscription & Billing

4.1 Subscription Plans

InterviewGlitch offers several subscription tiers (Free, Silver, Gold, Platinum). Each plan includes specific features and monthly credit allocations. Full details are available on our Pricing page.

4.2 Billing Terms

• Payment: All payments are processed through Stripe and billed monthly or annually based on your selection
• Auto-Renewal: Subscriptions automatically renew unless canceled before the renewal date
• Price Changes: We may adjust pricing with 30 days' notice. Changes apply to future billing cycles
• Taxes: You are responsible for any applicable taxes on your subscription

4.3 Money-Back Guarantee

All paid plans come with a 5-day money-back guarantee. During this period:

• You have full access to the plan's features
• If not satisfied, contact support within 5 days for a full refund
• After 5 days, you can cancel anytime - access continues until billing period ends
• Cancellation does not provide automatic refund after the 5-day period

4.4 Credit System

Credits are your access to InterviewGlitch services. Key points about credits:

• Credits are non-refundable and have no cash value
• Unused credits expire based on your plan tier
• Credits cannot be transferred between accounts
• Downgrading plans may result in credit reduction to the new plan's limits
• You can purchase additional credits at any time

5. Refund Policy

5.1 5-Day Money-Back Guarantee

We offer a 5-day money-back guarantee on all paid subscription plans. If you're not satisfied with InterviewGlitch within the first 5 days of your subscription:

1. Contact support@interviewglitch.com with your request
2. Provide your account email and reason for refund request
3. We will process your refund within 5 business days
4. Refund will be issued to your original payment method

5.2 Refunds After 5 Days

After the 5-day period, refund requests are evaluated on a case-by-case basis. Eligible scenarios include:

• Technical issues preventing service use
• Billing errors or duplicate charges
• Service unavailability for extended periods

5.3 Non-Refundable Items

• Purchased credit packs (once used)
• Annual subscription plans (after 5 days)
• Refunds requested after account deletion

6. Intellectual Property

6.1 Our Intellectual Property

InterviewGlitch, including all code, design, text, graphics, and functionality, is owned by Glitchworks Technologies Pty Ltd or licensed from third parties. All intellectual property rights are reserved. You agree not to:

• Copy, modify, or create derivative works
• Rent, lease, or sell the service
• Reverse engineer or decompile the software
• Remove copyright or trademark notices
• Use the service for competitive purposes

6.2 Your Content

You retain ownership of any content you upload (resumes, job descriptions, interview notes). By using InterviewGlitch, you grant us permission to:

• Process and store your content for service delivery
• Use your data to improve our Services (anonymized)
• Display your content within your account

We will not share your personal content with third parties except as required to provide the Services or as specified in our Privacy Policy.

7. Disclaimers & Limitations

7.1 "As-Is" Service

InterviewGlitch is provided "as-is" without warranties of any kind. We do not guarantee:

• Uninterrupted or error-free service
• Specific results or job offer success
• Accuracy of transcriptions (99% accuracy target, not guaranteed)
• Compatibility with all meeting platforms
• Availability in all regions

7.2 No Warranty

We provide no warranties, express or implied, regarding the Services. This includes warranties of merchantability, fitness for a particular purpose, or non-infringement.

7.3 Third-Party Services

InterviewGlitch integrates with third-party services (Zoom, Google Meet, OpenAI, etc.). We are not responsible for:

• Outages or issues with third-party platforms
• Changes to third-party APIs or services
• Data handling by third parties

8. Limitation of Liability

8.1 Liability Cap

To the maximum extent permitted by law, we are not liable for:

• Indirect, incidental, or consequential damages
• Lost profits, revenue, or data
• Damages caused by third parties
• Loss of employment or job opportunities

Our total liability shall not exceed the amount you paid for InterviewGlitch in the 12 months preceding the claim.

You agree to indemnify and hold harmless InterviewGlitch from any claims, damages, or costs arising from:

• Your violation of these Terms
• Your misuse of the Services
• Your violation of applicable laws
• Your infringement of third-party rights
• Using the service unethically in actual interviews

11. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in the United States, and you irrevocably consent to the jurisdiction and venue of such courts.

12. Dispute Resolution

12.1 Informal Resolution

Before initiating legal proceedings, we encourage you to contact us to resolve any disputes:

12.2 Binding Arbitration

If informal resolution fails, you agree to binding arbitration instead of court proceedings, except:

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
